| | I think that is exactly what happened PhilMH.
As I recall the situation, retailers like HMV argued that if something was legally on sale in one EU country then according to the provisions of the Maastricht Treaty etc. then it was legal elsewhere. What eventually happened was that Belgium changed their copyright law to fall into line with the 50 year rule (I think a couple of other EU countries had 25 years as well and also changed). |

| | What is the legal situation if recordings are out of copyright in one country, but retailed in another country where they are still subject to copyright? As I understand it, the UK's copyright limit at the time was 50 years, so if HMV and other retailers were selling this, and it came to the attention of PolyGram (Motown's then owner) and the BPI, then I would think - and hope - that serious questions would have been asked. |

| | Interesting observation TopPopper. When I bought this CD (at the HMV Megastore at Oxford Circus, London) there were five or six other volumes of "Detroit Rare Tracks", all featuring similar artwork, in the racks.
I wonder if the downfall of Marginal was caused more by them "borrowing" the visual artwork, rather than by them using "out of copyright" audio material. I have a Marginal CD by Chris Clark which has a cover virtually identical to the original Motown "Soul Sounds" LP, an Elgins/Monitors compilation that uses artwork blatantly similar to the Elgins "Darling Baby" LP and a collection of "Detroit Instrumentals" that uses the Earl Van Dyke "That Motown Sound" cover. |
