How can you have a secret treaty? If there are no referees or witnesses to it how can it be binding?

According to one compilation of secret treaties published in 2004, there have been 593 secret treaties negotiated by 110 countries and independent political entities since the year 1521

And that's only countries where there's some kind of Freedom Of Information law - how many more must there be?
