Ebay lawsuit

It appears Ebay is being sued over its allowing counterfeit products to be sold on the site. So I guess if you're after a dodgy box set for a fraction of the normal price, it could soon be too late...

The article includes:

"Among the many complaints, the lawsuit alleges eBay developed and maintains a pervasive practice of obstructing and ignoring counterfeit enforcement through sham customer support programs. eBay purports to police such counterfeiting through its policy which states "You can't list replicas, fakes, counterfeits, or other illegal copies on eBay." However, test purchases have proven this is simply lip service offered to address a known, extensive and ongoing problem. Reality is starkly different,"

Thanks for the heads-up, TP. I've browsed E-Bay, even attempted bidding(not successful) but with this info to hand, I'll avoid E-Bay from here on!

I'd like to see their "proof" that ebay knowingly allows fraud. Let's say I'm skeptical of their guilt. I believe they do their best, and the rest is just a complicated business. Copyright owners are known to be whackos in their approaches. But whatever.

Just search for Beatles box sets - Mono box, or US albums for instance. They are so obviously pirate copies - the price alone tells you. I also know a couple of stamp collectors who have repeatedly told Ebay that specific forgeries and doctored items are selling for high prices to unsuspecting buyers. Ebay do literally nothing about it.

Personally, I don't object much to counterfeit box sets, when anyone buying them must surely know what they are getting, but duping collectors with fake goods is not on.

I reported one seller to ebay about what appeared to be fake. Ebay's form had no space for any explanation whatsoever. Just press to report. Sloppiness for sure.
But I never saw that seller again. It's also possible they penalized without knowing proof. Stupidity or sloppiness does not equal intentional criminal complicity in fraud.
Ebay needs it proven to their satisfaction. Bad judgment is not criminal.

I guess the court will decide whether they are being sloppy or using bad judgement. To me it's as plain as day that they turn a blind eye to the issue, since they take a cut of the very vast revenues sellers generate. I don't condemn them for it, by the way, but I'm certain they know even better than you or me, that there are fake goods for sale on their site. And I know it 100 percent!

It is interesting that Ebay has been able to get away with allowing sellers to make the most outlandish (e.g., "rare!!!!") or even clearly wrong claims about their products. Traditional auction houses like Christie's or Sotheby's would have an expert appraiser actually handle the object and try to accurately describe it because the auction house would get in trouble were they to sell fakes. Maybe it's time that Ebay is held to similar standards. Although then the knowledgeable collector will also no longer be able to profit from an ignorant seller's complete mislabeling of their items. Moreover, I really don't know how Ebay is supposed to guarantee an item's authenticity without actually having someone personally check out the item.

BTW, as much as it seems appropriate to illustrate a discussion about fakes with fake Latin, it's actually "caveat emptor" (let the buyer beware!).

Here it might be "Beware you! The buyer..." rather than the more general "Let any buyer beware".
